VEGAS SPORTS JACKPOT RAFFLE - OFFICIAL RULES AND REGULATIONS

 

By participating in the raffle, entrants fully and unconditionally agree to be bound by these Official Rules and Regulations (“Official Rules”) of the United Way of Southern Nevada’s (“UWSN”) Vegas Sports Jackpot Raffle, as fully set forth below.  The UWSN’s interpretation and application of the Official Rules shall be final. In the event of any dispute, a reasonable interpretation or determination by the UWSN regarding the application of these Official Rules is final and binding in all matters related to the Raffle. This raffle is being undertaken and conducted pursuant to Nevada law and is VOID WHERE PROHIBITED BY LAW AND OUTSIDE THE UNITED STATES.

 

SPONSOR.  United Way of Southern Nevada (herein referred to “UWSN” or “Sponsor”), a Nevada nonprofit corporation that has been recognized by the Internal Revenue Service as a Section 501(c)(3) tax-exempt organization, is the sponsor of the raffle.  Per the requirements of Nevada law, Sponsor has registered with the Nevada Gaming Control Board to undertake charitable raffles, including this raffle, and has obtained approval from the Board to conduct online raffle ticket sales.

 

RAFFLE PERIOD AND PURCHASE OF TICKETS.  Raffle tickets will cost $100 per ticket and will be sold online at www.vegassportsjackpot.com or at various Kiosk locations from September 14, 2023 through 12:00PM Pacific time on January 28, 2024 (“the Raffle Period”). Only one (1) entry is required to be purchased by an eligible individual to enter the raffle; however, there is no limit to the number of raffle entries an eligible individual may purchase.

 

Online purchases will be processed via the BUMP 50:50 System and related software, which is an online platform that will facilitate sales of raffle tickets and undertake follow-up communications with entrants via text messages (if the entrant provides a mobile phone number when purchasing a raffle ticket), emails or other electronic format via mobile, tablet and PC devices.  Confirmation of purchased ticket will be sent via email.

 

A raffle ticket represents a chance to win the opportunity to accept Sponsor’s offer of the stated prize. All sales of raffle tickets are final, and no refunds will be paid, except in Sponsor’s sole and absolute discretion.  Sponsor reserves the right to reject any ticket reservation request that is submitted with payment that does not constitute “good funds.” A ticket issued in exchange for a credit card charge that was declined, invalid, stolen or unauthorized is void and cannot be a winning ticket.

 

All raffle tickets must be purchased by 12:00pm Pacific time on January 28, 2024. Any raffle ticket orders or requests to purchase raffle tickets received after this deadline will be void. Sponsor assumes no responsibility for lost, late, misdirected or non-delivered mail, email or fax messages, or any other failure to receive orders or deliver receipts prior to the drawing deadlines. All defective or altered raffle tickets or entry forms may be disqualified.

 

ELIGIBILITY.  During the Raffle Period, raffle tickets may only be purchased by persons 18 years or older who are legal residents of the United States of America, and physically located in Nevada at the time of purchase, pursuant to NRS 462.180, Nevada Gaming Control Board (“NGCB”) Regulations 4A.040 and 4A.050, and the NGCB’s rules for charitable raffles. Purchased raffle tickets are only valid for the drawing that takes place for this raffle.  Any individual undertaking an online purchase of raffle tickets will be required to certify they are physically present in Nevada at the time of purchase. Any individual that cannot make such certification is not eligible to purchase raffle tickets, and will not be able to proceed with any purchase. To be eligible, the winner will also be required to provide all information required for the Sponsor to complete all necessary income tax reporting.

 

A raffle ticket purchased by an ineligible individual, as determined by Sponsor, is void and cannot be a winning ticket. No refunds will be made to ineligible purchasers, except in Sponsor’s sole and absolute discretion.  A raffle ticket can be purchased as a gift on behalf of another person. Any purchase of a raffle ticket creates an entry on behalf of the purchaser.

 

An entrant’s winning the raffle and receipt of any prizes offered by Sponsor is contingent upon the entrant fulfilling all eligibility requirements set forth in these Official Rules, through the raffle drawing. Sponsor will verify the eligibility of the winner of the raffle.

 

The following persons are NOT ELIGIBLE to participate in the Raffle:

 

  • Employees, 1099 contractors and board members of the following organizations, and the immediate family members of such employees, 1099 contractors and board members :
    • United Way of Southern Nevada
    • Las Vegas Super Bowl Host Committee, Inc.
    • Las Vegas Super Bowl Host Committee Charities
    • Bump, a Division of CBN

 “Immediate family members” includes the spouse, parents, in-laws, grandparents, great-grandparents, brothers, sisters, children, grandchildren, and great-grandchildren of the employee and his/her spouse. This definition also includes individuals for whom an employee is the current legal guardian and individuals who reside in the same house as employee or immediate family member whether or not they are related. (“Step” relationships are also covered by this definition).

 

ODDS.  The odds of winning the raffle depend on the number of valid raffle tickets sold.

 

DRAWING.  One (1) winning raffle entry will be randomly drawn by UWSN through the BUMP 50:50 System on January 28, 2024, after the conclusion of the AFC Championship game. The name of the winning entrant will be notified by email and via text message (if the winner provides a mobile phone number when purchasing a raffle ticket), and the winner will also be posted on the Vegas Sports Jackpot and UWSN websites (www.vegassportsjackpot.com and www.uwsn.org) and UWSN social media channels for a period of three (3) days after the drawing.  The potential winner does not need to be present at the drawing to win, but must comply with all terms and conditions in these Official Rules.

  • Super Bowl Experience
  • Super Bowl Opening Night fueled by Gatorade
  • Every Las Vegas Raiders home game
  • Twenty-two (22) Las Vegas Golden Knights home games
  • Every Henderson Silver Knights home game
  • Every 2022 Las Vegas Aces home game
  • Every Vegas Knight Hawks home game
  • Every Las Vegas Aviators home game
  • Every UNLV football home game
  • Every UNLV men’s basketball home game
  • Every UNLV women’s basketball home game
  • The first four days of the Wrangler National Finals Rodeo (“NFR”)
  • The SRS Distribution Las Vegas Bowl (men’s college football)
  • The Vegas Kickoff Classic (men’s college football)
  • Four (4) tickets to the 2024 NBA Summer League - Winner can use four (4) tickets for one session or two (2) tickets for two (2) sessions
  • Formula 1 Heineken Silver Las Vegas Grand Prix
  • Shriners Children’s Open - two (2) tickets on Saturday and (2) tickets on Sunday
  • NASCAR – Pennzoil 400 presented by Jiffy Lube
  • NASCAR – South Point 400
  • Four Ultimate Fighting Championship (“UFC”) events in Las Vegas, including International Fight Week

Sponsor does not guarantee any particular location for the tickets offered as prizes, ticket quality or location, and any event privileges or access associated with any ticket.  Receipt of tickets for any listed events does not connote season ticket status and any corresponding privileges from the relevant team or organization.  During the Raffle Period, Sponsor may add additional Las Vegas-related events to which the raffle winner will be offered two (2) tickets.  Tickets to listed events in these Official Rules are based on Sponsor’s receipt of commitments from each respective team or organization to donate the tickets to Sponsor for use as a prize in the raffle.  If tickets to any listed event become unavailable for reasons outside of Sponsor’s control (for example, the tickets are unexpectedly cancelled or retracted by the respective team/organizational donors of such tickets), Sponsor reserves the right to substitute tickets for an alternate game or event at Sponsor’s sole discretion. 

 

Each prize consists only of two (2) tickets to the relevant game or event.  Sponsor shall not pay for or reimburse winner’s additional costs and expenses, including air and/or ground transportation to or from any game or event, lodging expenses, meals, food/beverage charges, baggage charges, parking charges, rental, or any other incidental costs of attending a game or event. The winner is solely responsible for any additional costs incurred by the winner and any guest in connection with accepting a prize.

 

CLAIMING PRIZES.  Upon an entrant’s raffle ticket being selected as the winning ticket, such individual becomes a potential winner only.  The potential winner will have until 5pm Pacific Time on January 31, 2024 (the “Initial Expiration Date”), to accept or decline the Sponsor’s offer of the Super Bowl LVIII and Super Bowl Experience prizes, and until 5pm Pacific Time on February 27, 2024, (the “Final Expiration Date”) to accept or decline the additional prizes being offered by the Sponsor.  If the initial potential winner does not accept the Super Bowl LVIII and Super Bowl Experience prizes by the Initial Expiration Date, the initial winner will forfeit all prizes and a new potential winner will be drawn.  The subsequent potential winner(s) will have 72 hours from the date of being selected as a potential winner to accept or decline the Super Bowl LVIII and Super Bowl Experience prizes, or will also forfeit all prizes.

 

Prior to the Initial Expiration Date, the potential winner will be required to provide the following to Sponsor:  (A) proof of identification (B) an executed liability, publicity release in the form provided by the Sponsor, (C) executed Internal Revenue Service forms or other tax-related forms and documentation as may be needed by Sponsor to apply any taxes or withholdings as may be required by law; and (D) any other items required by Sponsor to confirm the potential winner’s eligibility under these Official Rules.

 

The liability/ publicity release, any tax-related forms and documentation, and any eligibility-related confirmation documents and information must be executed and delivered to the authorized Sponsor representative prior to the Expiration Date.  Sponsor may conduct a background check to confirm any potential winner’s eligibility and compliance with these Official Rules. By entering, raffle participants agree to reasonably cooperate with any such background check. Because the prizes involve attendance at public event(s) and publicity, if a background check reveals that a potential winner has engaged in conduct that could damage the reputation or business of any Sponsor Entity, as determined by Sponsor in its sole discretion, the potential winner may be disqualified as ineligible and the prize may be awarded to an alternate winner.

 

If the potential winner does not present and surrender the winning ticket to Sponsor or doesn’t otherwise comply with the other requirements of these Official Rules by the Expiration Date, the potential winner will not be entitled to receive any prizes.  If, during the eligibility verification process, the potential winner is found not to be eligible, or otherwise does not comply with these Official Rules, the potential winner will also not be entitled to receive any prizes.  Upon the occurrence of any of these events, the potential winner will be deemed to have forfeited any prizes, and Sponsor may conduct an alternate drawing to determine another potential winner of the raffle and the prizes. 

 

Following a potential winner’s fulfillment of the above-referenced requirements before the Expiration Date, Sponsor shall be entitled to request additional information, documentation, or tax withholdings from the winner from time to time in connection with prizes.  Such information may include confirmation of the winner’s acceptance of a particular prize, tax documentation or forms in connection with a particular prize, or other information relating to the availability and supply of prizes.  

 

In addition, and as set forth below, Sponsor may require the winner to supply any federal income tax withholdings or amounts as are required to be remitted by Sponsor to the IRS or any other taxing authority by law.  The winner shall fulfill all such requests prior to a time determined by Sponsor in order to receive such prizes.  If the winner does not fulfill such requirements any prize will be forfeited. 

 

A potential winner has the option to decline to accept Sponsor’s offering of a particular prize.   However, tickets to an individual series of games or events (e.g., tickets to all Las Vegas Raiders home games) are being offered as a non-separable ticket package, and therefore must be claimed by the potential winner on an “all-or-none” basis.  The potential winner is not permitted to accept tickets to certain Raider home games and decline tickets to others.

 

RELEASE OF LIABILITY.  Raffle participants agree to be bound by these Official Rules. By entering the raffle, each raffle participant releases and discharges the Sponsor, and any other party associated with the development or administration of this raffle, their parent, subsidiary, and affiliated entities, and each of their respective officers, directors, members, shareholders, employees, independent contractors, agents, representatives, successors and assigns (collectively, “Sponsor Entities”), from any and all liability whatsoever in connection with this raffle, including without limitation legal claims, costs, injuries, losses or damages, demands or actions of destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light) (collectively, “Claims”).

 

Except where prohibited: (i) entry into the raffle constitutes the consent of the raffle participant, without further compensation, to use his/her name, likeness, biographical data, and contact information for editorial, advertising, marketing, publicity, and administrative purposes by the Sponsor and/or others authorized by the Sponsor; (ii) acceptance of a prize constitutes a release by any winner of the Sponsor Entities of any and all Claims in connection with the administration of this raffle and the use, misuse, or possession of any prize; (iii) any potential winner may be required to sign an affidavit of eligibility (including social security number) and a liability/publicity release; and (iv) if prize involves travel or activities, any potential winner and travel companion (if applicable) may be required to execute releases of the Sponsor from any and all liability with respect to participation in such travel/activities and/or use of the prize.

 

LIMITATION OF LIABILITY.  Each winner hereby releases and holds Sponsor harmless with respect to any claims related to the raffle. A raffle entrant’s sole and exclusive remedy for any breach of duty or conduct related to the raffle shall be limited to the return of the purchase price paid for his or her raffle tickets. In no event shall Sponsor be liable to any person for any loss or injuries to earnings, profits or goodwill, or for any incidental, special, punitive or, consequential, or other damages of any person or entity whether arising in contract, tort or otherwise, arising out of the raffle, use or ownership of the prizes.

 

TAXES.  The value of each selected prize is includible in the winner’s gross income and may be subject to reporting by Sponsor to the Internal Revenue Service (“IRS”) or other taxing authorities. Each winner is solely responsible for payment of all federal, state, and/or local income, sales, or use taxes due on account of his or her acceptance of the prize.  The actual fair market value(s) of prizes as ultimately determined by the respective prize donors are final and binding and cannot be challenged or appealed.  In the event the stated approximate retail value(s) of a prize is more than the actual fair market value of that prize, the difference will not be awarded in cash or otherwise.  

 

With respect to any prize with a value of more than $5,000, the Internal Revenue Service requires Sponsor to withhold federal income tax at the rate of 25%, or the current rate as established by the IRS.  Other taxing jurisdictions, including state and local jurisdictions, may also require income tax withholdings or other tax withholdings to be applied in connection with any prize or all prizes.  If Sponsor determines that such withholdings, or any other withholdings, are required to be applied and remitted by Sponsor for any prize or all prizes under applicable law, Sponsor shall require the winner to pay such withholding amount to Sponsor as a condition of receipt of the relevant prize or prizes.  The winner is solely responsible for all tax consequences of the raffle and their declining, accepting, or receiving any prize, and must consult their own tax professional to determine their compliance with all tax laws. 

 

Any and all applicable federal, state, and local taxes and all fees and expenses related to acceptance and use of prize not specifically stated herein, including but not limited to, financing charges, change of air travel fees, ground transportation, automobile insurance, meals, incidentals, passenger tariffs or duties, surcharges, service charges or facility charges, personal charges at lodging, security fees and/or other expenses, are the responsibility solely of winner.

 

PRIZE RESTRICTIONS.  Prizes cannot be substituted, assigned, transferred, or redeemed for cash; however, Sponsor reserves the right to make equivalent prize substitutions at its sole discretion.

 

Sponsor will not replace any lost or stolen prizes or components of a prize(s). Prizes cannot be used in conjunction with any other promotion or offer. Only the number of prizes stated in these Official Rules is available to be won in the raffle.

 

Prizes are not intended to be sold or transferred by the winner(s) of the raffle, and if the winner(s) are found doing so, they may lose their rights and privileges to any additional prizes.  Prizes not accepted by the winner(s) will be owned by UWSN and may be used for other charitable purposes without restriction. This could include Sponsor’s conduct of additional or separate raffles. Prizes can be given out in the seasonal year in which they are available and can roll over into the following calendar years as applicable.

DISCLAIMERS.  UWSN, in its sole discretion, reserves the right to disqualify any individual it finds tampering with the entry process or operation of the raffle or to be acting in violation of these Official Rules. Any attempt by any person or organization to damage, interfere with or undermine the legitimate operation of this raffle may be a violation of criminal and civil law. Should such an attempt be made, UWSN reserves the right to seek damages (including attorneys fees) and any other remedies from any such person to the fullest extent permitted by law. Failure of UWSN to enforce any provision of these Official Rules shall not constitute a waiver of that provision.

 

If, for any reason, the raffle is subjected to infection by computer virus or bugs, tampering, unauthorized intervention, fraud or suspected fraud, technical failures, or any other causes which call into question the fairness or legality of this raffle, Sponsor may, in its sole discretion, void any suspect entries and (a) cancel or terminate the raffle (or any portion thereof); (b) modify or suspend the raffle and then resume the raffle in a manner that best conforms to the spirit of these Official Rules; and/or (c) determine the winner from among the eligible, non-suspect entries received up to the time of impairment, and all eligible entries received.

 

Sponsor further reserves the right to cancel, terminate or modify the raffle if it is not capable of completion as planned, including by reason of force majeure or technical failures of any sort. In the event this raffle is cancelled or terminated, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein.

 

Sponsor Entities are not responsible for errors in the administration or fulfillment of this raffle, including without limitation mechanical, human, printing, distribution or production errors, and may cancel, terminate, or modify this raffle based upon such error at its sole discretion without liability. In no event will Sponsor be responsible for awarding more than the number of prizes specified in these rules.

 

Sponsor entities make no warranties, representations, or guarantees, express or implied, in fact or in law, as regards this raffle or the merchantability, quality, or fitness for a particular purpose regarding any prize or any component of any prize.
